Acceptance
These Terms of Service ("Terms") govern your use of Cadence, operated by Cadence Inc. ("Cadence", "we", "us"), a Delaware corporation. By creating an account or using the service, you agree to these Terms.
If you do not agree, do not use Cadence.
What Cadence is and is not
Cadence is a supportive daily logging tool for people managing a long-term health condition. It helps you keep a clearer picture of how you are doing and communicate more effectively with your care team.
Cadence is not a medical device. It is not a healthcare provider. It does not provide medical advice, diagnosis, or treatment. It does not prescribe medication, give dosing instructions, or recommend changes to your treatment plan. Any information Cadence produces, including trends, suggested questions, and visit summaries, is informational only and does not replace the advice of a qualified clinician.
Medical decisions, including starting, stopping, or changing any medication or treatment, must involve your doctor, nurse practitioner, or other licensed healthcare professional. If you have a medical emergency, call 911 or go to the nearest emergency room.
Accounts
You must be at least 13 years old to create an account. You are responsible for keeping your password secure. You must provide accurate information when you sign up and keep it current.
You may not create an account on behalf of someone else without their consent. You may not share your account credentials.
We may suspend or terminate an account that violates these Terms, after notice where practicable.
Acceptable use
You may use Cadence only for lawful purposes and only as permitted by these Terms. You agree not to:
- Use Cadence to provide medical advice to others or to hold it out as a medical tool.
- Attempt to reverse engineer, scrape, or extract data from Cadence's systems.
- Introduce malicious code, perform denial-of-service attacks, or attempt to gain unauthorized access.
- Use Cadence to store or transmit unlawful content.
- Misrepresent your identity or impersonate another person.
Subscriptions and billing
Cadence offers a free tier and paid subscription plans billed in US dollars. Prices are displayed at checkout and on our Pricing page.
Paid subscriptions renew automatically at the end of each billing period unless you cancel. You can cancel at any time from Settings. Cancellation takes effect at the end of the current period; you are not charged for the next period after cancellation.
We do not offer refunds for partial periods, except where required by law. If you believe a charge was made in error, contact us at support@getcadence.tech and we will review it.
We may change prices on reasonable notice. If a price increase applies to your plan, we will notify you before the next renewal, and you may cancel if you do not agree.
Your data
You own the health data you log into Cadence. We hold it to provide the service. We do not claim any ownership over your logs, readings, or profile information.
You can export your data as JSON or permanently delete your account and all associated data from Settings at any time. See our Privacy Policy for details.
Intellectual property
Cadence and its content, software, and design are owned by Cadence Inc. or its licensors and are protected by copyright, trademark, and other laws. You may not copy, distribute, or create derivative works from Cadence's content without written permission.
You retain ownership of the content you log. You grant Cadence a limited licence to process and display your content solely to provide the service to you.
Disclaimers
Cadence is provided "as is" and "as available". To the maximum extent permitted by law, Cadence Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that Cadence will be uninterrupted, error-free, or accurate. Health data trends and visit summaries are informational and may be incomplete. They are not a substitute for professional medical judgment.
Limitation of liability
To the maximum extent permitted by law, Cadence Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, even if we were advised of the possibility.
Our total liability to you for any claim arising from these Terms or your use of Cadence will not exceed the amount you paid us in the 12 months before the claim arose, or US$100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Cadence Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of Cadence, your violation of these Terms, or your violation of any rights of another person.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to that jurisdiction.
Before bringing any formal claim, please contact us at legal@getcadence.tech and give us a reasonable opportunity to resolve the issue.
Changes to these Terms
We may update these Terms from time to time. We will notify you by email and by posting the updated Terms with a new effective date. If the changes are material, we will give you reasonable notice before they take effect. Continued use of Cadence after the update means you accept the revised Terms.
